🇸🇦 الشروط والأحكام العامة لتطبيق XCar
أولاً: التعريفات
- التطبيق: تطبيق XCar، منصة تقنية إلكترونية وسيطة لتأجير السيارات، تعليم السواقة، وخدمات ترجمة/استخراج الرخص الدولية.
- المستخدم: أي شخص طبيعي أو اعتباري يستخدم التطبيق.
- المؤجر: فرد أو مكتب أو شركة تعرض مركبة للإيجار عبر التطبيق.
- المستأجر: المستخدم الذي يقوم باستئجار مركبة عبر التطبيق.
- مزود الخدمة التعليمية: مدارس أو أكاديميات تعليم السواقة المعتمدة.
- الرخصة الدولية: خدمة ترجمة أو استخراج رخصة قيادة دولية وفق الأنظمة المعمول بها.
ثانياً: نطاق التطبيق والخدمات
يوفر التطبيق الخدمات التالية:
- الربط بين المؤجرين والمستأجرين لتأجير المركبات.
- الربط مع مدارس وأكاديميات تعليم السواقة.
- تقديم خدمات ترجمة أو استخراج الرخص الدولية بالتعاون مع جهات معتمدة.
- إدارة الحجوزات، الطلبات، والدفع الإلكتروني عند توفره.
ثالثاً: شروط التسجيل والتحقق
- يلتزم المستخدم بتقديم معلومات صحيحة ومحدثة.
- يخضع المستخدم لإجراءات التحقق (الهوية، الرخصة، وسائل الاتصال).
- يحق للتطبيق تعليق أو إلغاء الحساب في حال:
- تقديم معلومات غير صحيحة
- الاشتباه في نشاط مخالف أو احتيالي
- الحد الأدنى للعمر لا يقل عن 21 سنة لاستئجار المركبات ما لم تنص القوانين المحلية على خلاف ذلك.
رابعاً: شروط تأجير السيارات
1) التزامات المؤجر
- التأكد من سلامة المركبة قانونيًا وفنيًا.
- وجود تأمين ساري المفعول.
- تقديم معلومات وصور دقيقة للمركبة.
- الالتزام بمواعيد التسليم والاستلام.
2) التزامات المستأجر
- استخدام المركبة للأغراض القانونية فقط.
- عدم تسليم المركبة لطرف ثالث.
- الالتزام بمدة العقد.
- إعادة المركبة بالحالة المتفق عليها.
- تحمل تكاليف الأضرار أو المخالفات.
3) التأمين والمسؤولية
- يتحمل المستأجر مسؤولية المخالفات والحوادث الناتجة عن سوء الاستخدام.
- في حال عدم كفاية التأمين، يتحمل المستأجر كامل الأضرار.
خامساً: الرسوم والدفع
- جميع الرسوم معروضة بوضوح داخل التطبيق.
- لا يتم استرداد الرسوم إلا وفق سياسة الإلغاء.
- يحق للتطبيق خصم الغرامات أو المستحقات وفق الشروط المعلنة.
سادساً: سياسة الإلغاء والاسترجاع
- يخضع الإلغاء لشروط زمنية محددة.
- الإلغاء المتأخر أو عدم الحضور قد يترتب عليه غرامات.
- لا يحق الاسترجاع في حال مخالفة الشروط.
سابعاً: شروط ترجمة أو استخراج الرخص الدولية
- الخدمة لا تُعد بديلاً عن الرخصة الوطنية.
- المستخدم مسؤول عن صحة المستندات.
- يحق للتطبيق رفض الطلب في حال عدم استيفاء الشروط.
- لا يتحمل التطبيق مسؤولية رفض أي جهة خارجية الاعتراف بالرخصة.
ثامناً: شروط تعليم السواقة
- الأكاديميات مسؤولة عن جودة التدريب.
- التطبيق وسيط تقني فقط.
- يلتزم المتدرب بالحضور والالتزام بتعليمات السلامة.
تاسعاً: المسؤولية القانونية وإخلاء المسؤولية
- التطبيق منصة تقنية إلكترونية وسيطة ولا يُعد طرفًا في أي عقد بين المستخدمين.
- لا يتحمل التطبيق مسؤولية: الحوادث أو الأضرار، المخالفات المرورية، النزاعات بين الأطراف.
- تقع المسؤولية القانونية والمالية كاملة على: المؤجر والمستأجر ومزودي الخدمات.
- يوافق المستخدم على تعويض التطبيق عن أي مطالبات ناتجة عن مخالفته للشروط.
- لا يؤثر بطلان أي بند على سريان باقي البنود.
⚠️ تمت صياغة بند المسؤولية بما يتوافق مع سياسات Google Play دون إسقاط الحقوق النظامية الإلزامية.
عاشراً: الخصوصية وحماية البيانات
- يتم جمع البيانات وفق سياسة الخصوصية.
- يلتزم المستخدم بعدم إساءة استخدام بيانات الآخرين.
- قد يتم مشاركة البيانات مع الجهات الرسمية عند الطلب القانوني.
الحادي عشر: إنهاء الخدمة
- يحق للتطبيق تعليق أو إنهاء الحساب عند المخالفة.
- يحق للمستخدم إنهاء الحساب بعد تسوية الالتزامات.
الثاني عشر: القانون والاختصاص
- تخضع هذه الشروط لقوانين الدولة التي يعمل بها التطبيق.
- تختص محاكم تلك الدولة بالنظر في النزاعات.
الثالث عشر: أحكام عامة
- استخدام التطبيق يعني الموافقة الكاملة على هذه الشروط.
- يحق للتطبيق تعديل الشروط في أي وقت، ويُعد الاستمرار في الاستخدام موافقة ضمنية.

- User: Any individual or legal entity using the app.
- Lessor/Owner: An individual, office, or company offering a vehicle for rent through the app.
- Renter: The user who rents a vehicle through the app.
- Driving Education Provider: Approved driving schools/academies.
- International License: A service to translate or issue an international driving license in accordance with applicable regulations.
2. Scope of Services
The app provides the following services:
- Connecting vehicle owners/lessors with renters.
- Connecting users with driving schools/academies.
- Providing international license translation/issuance in cooperation with authorized entities.
- Managing bookings, requests, and electronic payments when available.
3. Registration & Verification
- Users must provide accurate and up-to-date information.
- Users may be subject to verification (identity, license, contact details).
- The app may suspend or terminate an account in case of:
- Providing false information
- Suspected fraud, misuse, or violations
- Minimum age for renting vehicles is 21 unless local laws state otherwise.
4. Car Rental Terms
4.1 Owner Obligations
- Ensure the vehicle is legally and technically safe.
- Maintain valid insurance.
- Provide accurate vehicle information and photos.
- Commit to pickup and drop-off schedules.
4.2 Renter Obligations
- Use the vehicle for lawful purposes only.
- Do not hand over the vehicle to a third party.
- Comply with the rental period/contract.
- Return the vehicle in the agreed condition.
- Bear costs of damages and traffic fines/violations.
4.3 Insurance & Liability
- The renter is responsible for violations and accidents caused by misuse.
- If insurance is insufficient, the renter bears the full damages.
5. Fees & Payments
- All fees are clearly shown in the app.
- Refunds are subject to the cancellation policy.
- The app may charge penalties/dues according to announced terms.
6. Cancellation & Refund Policy
- Cancellations are subject to time-based conditions.
- Late cancellation or no-show may result in penalties.
- No refunds apply in case of terms violations.
7. International License Service Terms
- This service is not a substitute for a national driving license.
- Users are responsible for the accuracy of submitted documents.
- The app may reject requests if requirements are not met.
- The app is not responsible if external authorities refuse recognition.
8. Driving Lessons Terms
- Driving schools/academies are responsible for training quality.
- The app acts as a technical intermediary only.
- Trainees must attend and follow safety instructions.
9. Legal Liability & Disclaimer
- The app is a technical intermediary and is not a party to agreements between users.
- The app is not responsible for accidents/damages, traffic violations, or disputes between parties.
- Legal and financial responsibility lies with the owner, renter, and service providers.
- Users agree to indemnify the app against claims arising from their violation of these terms.
- If any clause is deemed unenforceable, remaining clauses remain valid.
